3.2 Use of our products and services is subject to compliance with these terms and conditions.
4. Payment and Pricing:
4.1 Prices for products and services are as listed on our website or as agreed upon.
4.2 Late payments may incur 2.5% interest per month.
5. Delivery or Service Timeframe:
5.1 Delivery of products or completion of services may be conducted within or over 6-8 weeks. Any delays caused by us may get a corresponding compensation or credits.
6. Intellectual Property:
6.1Homelovers Group Limited retains all rights to intellectual property, including trademarks, copyrights, and patents.
6.2 Use of Homelovers Group Limited’s brand, logo, or proprietary information requires explicit permission.
7. Privacy and Data Protection:
7.1Homelovers Group Limited collects, uses, and protects customer information as outlined in our Privacy Policy.
7.2 Customer data may be shared with third parties only as necessary for the provision of products or services.
8. Cancellation and Termination:
8.1 Cancellation by Customer:
– Customers may cancel within 7 days before the scheduled date with a 5% fee under full amount.
– Cancellations after 7 days will result in the full deposit retained by Homelovers Group Limited.
8.2 Cancellation by Homelovers Group Limited:
– Homelovers Group Limited may cancel orders or terminate services due to unforeseen circumstances.
– Refunds or alternative solutions will be promptly communicated.
8.3 Early Termination:
– Early termination of ongoing services may incur a termination fee of 40% under full amount.
– Homelovers Group Limited retains the right to keep the full deposit for early termination initiated by the customer.
8.4 Refund Policy:
– Refunds for cancellations or early termination follow the terms outlined in this section.
– Deposits are non-refundable for cancellations initiated by the customer beyond Homelovers Group Limited’s control.
9. Warranty and Returns:
9.1 Ten years warranty for pergola, louvre systems, and outdoor blinds structure, two years warranty for outdoor blinds’ sheets.
– Damage to water leaks, peeling strips, posts, gutters, pipes, polycarbonate sheets etc. due to the heavy wind weather can be covered by the warranty.
– Loose curtains and fabric derails due to weather conditions can be covered by the warranty.
– Any parts damaged by man-made are not covered by the warranty.
– Warranty does not cover damages resulting from accidents, acts of nature (such as Over Level 10 storms and Over Level 6.5 earthquakes), alterations or modifications not authorized by us, or improper maintenance of the pergola and blinds.
– This warranty is transferable to subsequent owners of the pergola during the 10-year warranty period, provided the transfer is properly documented and approved by us.
– This warranty is in addition to any rights you may have under applicable laws, and it does not affect your statutory rights.
9.2 Returns, exchanges, refunds, or warranties are subject to the terms outlined on our website.
10. Liability and Indemnity:
10.1Homelovers Group Limited is not liable for any damages or losses beyond the scope of these terms and conditions.
10.2 The customer agrees to indemnify Homelovers Group Limited in certain situations.
11. Dispute Resolution:
11.1 Any disputes arising from the use of our products or services will be resolved through info@homelovers.co.nz.
